2. SCOPE AND ACCEPTANCE

These General Terms and Conditions ("Terms") govern the use of the website operated by IFP FILATI PREGIATI SRL ("we", "us", "the Company") and all purchases made through it. By accessing this website or placing an order, you ("the Customer", "you") confirm that you have read, understood, and accepted these Terms in their entirety. These Terms comply with Government Emergency Ordinance (OUG) 34/2014 on consumer rights in contracts concluded at a distance, Law 365/2002 on electronic commerce, and all other applicable Romanian and European Union legislation.

3. PRODUCT CHARACTERISTICS

We sell yarn stock and related textile products. Each product listed on the website includes a description of its main characteristics, including but not limited to: fiber composition (in accordance with EU Regulation 1007/2011 on textile fibre names and related labelling), weight, meterage, recommended needle size, and color. Product images are provided for illustrative purposes; slight variations in color may occur due to monitor settings or dye lot differences. We make every reasonable effort to ensure that descriptions and images are accurate. In case of material discrepancy, you have the right to return the product under the withdrawal provisions described below.

4. PRICES AND TAXES

All prices displayed on the website are expressed in the applicable currency and include Value Added Tax (VAT) where applicable, in compliance with Romanian fiscal legislation. The total price of the order, including all taxes, delivery charges, and any other additional costs, will be clearly communicated to you before the order is confirmed. If the price cannot be reasonably calculated in advance, the method of calculation will be provided. We reserve the right to modify prices at any time, but any price changes will not affect orders already confirmed.

5. PAYMENT METHODS

We accept the following payment methods: - Bank transfer to the company account (details provided at checkout and in the order confirmation email) - Online card payment (processed through a secure payment gateway) All payment transactions are processed securely. By providing your payment information, you confirm that you are authorized to use the chosen payment method. In case of payment failure or suspected fraud, we reserve the right to cancel or suspend the order and to notify the relevant authorities.

6. DELIVERY

Delivery is available to the destinations indicated on the website. Delivery costs, if any, are calculated based on the destination and the weight/volume of the order, and are clearly displayed before order confirmation. The estimated delivery timeframe is indicated at checkout or in the order confirmation email. Delivery times are estimates and not guaranteed; however, in all cases, delivery will occur within a maximum of 30 days from the date of order confirmation, unless otherwise agreed. Risk of loss or damage to the products passes to you at the time you (or a third party designated by you) take physical possession of the goods. If delivery is delayed beyond the agreed timeframe, you may request a new reasonable delivery period, and if we fail to deliver within that period, you are entitled to terminate the contract.

7. RIGHT OF WITHDRAWAL (OUG 34/2014, Art. 9-15)

In accordance with OUG 34/2014, you have the right to withdraw from the contract within 14 calendar days without giving any reason. The withdrawal period expires 14 calendar days from the day on which you or a third party indicated by you (other than the carrier) acquires physical possession of the goods. If your order consists of multiple goods delivered separately, the withdrawal period expires 14 calendar days from the day on which you acquire physical possession of the last good. To exercise the right of withdrawal, you must inform us of your decision by an unequivocal statement (e.g., a letter sent by post or email to italianafilatipregiati@gmail.com). You may use the standard withdrawal form available on our Returns page, but it is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired. Effects of withdrawal: If you withdraw from the contract, we will reimburse all payments received from you, including the cost of standard delivery (except for supplementary costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us). Reimbursement will be made without undue delay and in any event no later than 14 days from the day on which we are informed of your decision to withdraw, using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You must send back the goods without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal. The deadline is met if you send back the goods before the period of 14 days has expired. You will bear the direct cost of returning the goods. The goods must be returned in their original condition, unused, with all labels and packaging intact. You are liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. Exceptions: The right of withdrawal does not apply to goods made to the customer's specifications or clearly personalized, or to sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

8. LEGAL GUARANTEES

All products sold are covered by the legal guarantee of conformity in accordance with Romanian law (Law 449/2003 on the sale of products and associated guarantees) and EU Directive 2019/771. If a product is found to be non-conforming, you are entitled to have the product brought into conformity free of charge, to receive an appropriate price reduction, or to have the contract terminated, under the conditions provided by law. The legal guarantee of conformity applies for a period of 2 years from the date of delivery of the product.

10. ALTERNATIVE DISPUTE RESOLUTION (SAL/SOL)

In accordance with EU Regulation 524/2013, we inform you that the European Commission provides an Online Dispute Resolution (ODR) platform, accessible at: https://ec.europa.eu/consumers/odr This platform can be used by consumers to resolve disputes arising from online purchases without going to court. You may also seek resolution through the Alternative Dispute Resolution (ADR) entity designated by ANPC: SAL-ADR (Solutionarea Alternativa a Litigiilor), accessible via the ANPC website at https://anpc.ro. All content on this website, including but not limited to texts, images, graphics, logos, icons, photographs, product descriptions, software, and design, is the property of IFP FILATI PREGIATI SRL or its licensors and is protected by Romanian and international intellectual property laws. Reproduction, distribution, modification, or any other use of this content without prior written authorization from us is strictly prohibited.

13. APPLICABLE LAW AND JURISDICTION

These Terms are governed by and construed in accordance with the laws of Romania. Any disputes arising from or in connection with these Terms or your use of the website shall be submitted to the competent courts of Romania, without prejudice to mandatory consumer protection provisions that may grant you the right to bring proceedings before the courts of your place of residence. Nothing in these Terms affects your statutory rights as a consumer under applicable EU and Romanian law.

We reserve the right to modify these Terms at any time. Any changes will be published on this page and will take effect from the date of publication. It is your responsibility to review these Terms periodically. Continued use of the website after publication of changes constitutes acceptance of the modified Terms.
